BENGALURU:The High Court on Thursday directed the state government to file its objections to a petition filed by Bangalore Club, by July 28.
Hearing the club’s petition, Justice Raghavendra S Chauhan directed it to furnish copies of the amended petition wherein it had incorporated a challenge to the July 20, 2015 order passed by Bengaluru North Assistant Commissioner N Mahesh Babu asking them to hand over the 233-square-yard property to the government within seven days.
HC Comes to Aid of Visually Challenged
The High Court on Thursday came to the rescue of a 24-year-old visually challenged person who wanted to write an exam.
In a relief to V Prithviraj Aithal, who suffers from 75 per cent low vision, Justice Raghavendra S Chauhan directed the authorities to provide him with a scribe during the civil judges recruitment exam to be held on July 25 for recruitment to 211 posts of civil judges. Justice Chauhan directed the authorities to give Aithal extra time to complete his examination.
Justice Chauhan reminded the counsel for the state who had argued that rules did not permit such facilities for Aithal as he had applied under the general merit category.
Justice Chauhan observed that the state owes a duty to provide the physically challenged with opportunities as set out in Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and cannot take shelter under technicalities.
Aithal approached the court, seeking a direction to the authorities to increase the quota for physically challenged to 3 per cent as per the Act and for provision of reservation to visually challenged candidates in the civil judges selection exam.
HC Quashes Bail to Reddy Aide
The High Court on Thursday quashed the bail granted by a CBI court to Kenche Mahesh Kumar alias Karapudi Mahesh, a close associate of former minister G Janardhan Reddy, in the illegal mining case.
Allowing a criminal petition filed by the CBI seeking to quash the bail granted by a CBI court, a division bench headed by Justice Mohan Shantanagowdar observed that the lower court wrongly granted bail on the ground that there was a two-day delay in filing of chargesheet by the investigating agency.
Referring to the bail granted to Mahesh on November 30, 2013, the bench observed that the time of 90 days prescribed under Section 167 (2) of CrPC for grant of bail has to be counted from the date of production before a court and not from the date of issuance of the body warrant.
The CBI special court had issued body warrant against Mahesh on August 30, 2013 asking the prison authorities to produce him on September 2, 2013. The warrant was served to the authorities on August 31. Mahesh was in judicial custody in another case. Therefore, CBI had claimed that the 90-day deadline commenced from September 2, 2013, when Mahesh was remanded to custody and not from August 31, 2013.
